									<h2>New PIP powers: what changes from July 8, 2026?</h2><p><b>Bartek:</b><span style="font-weight: 400;"> From July 8, 2026, new regulations concerning the National Labour Inspectorate will come into force. What is the most important change?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> On July 8, 2026, an act comes into force granting new powers to the State Labour Inspection authorities. The essence of the reform is to strengthen the role of PIP in enforcing labour law provisions. The key change is the granting of authority to labour inspectors to issue decisions confirming the existence of an employment relationship in situations where cooperation based on civil law contracts (including B2B contracts), in reality, has characteristics that fall within the definition of an employment relationship set out in the Labour Code. This is a revolutionary change, as until now such determinations required a court ruling.</span></p><h2>B2B reclassification: what will the procedure look like?</h2><p><b>Bartek:</b><span style="font-weight: 400;"> What will the inspector’s procedure look like after finding that B2B cooperation may have features of an employment relationship?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> Under the new regulations, if a labour inspector, as a result of an inspection, determines that a given legal relationship has the characteristics of an employment relationship, they will first issue an order to remove the violations, e.g. setting a deadline to conclude an employment contract or adjust the actual terms of cooperation to comply with the law. Only if such an order is not complied with will administrative proceedings be initiated, leading to a decision reclassifying the civil law contract as an employment contract. Such a decision may be challenged by both parties before a labour court. The enforceability of the decision will then be suspended until a final court judgment is issued. The draft also provides for the possibility of interim protection during court proceedings, aimed at reducing the risk of termination of cooperation solely due to its legal classification being challenged.</span></p><h2>Does the PIP reform change the definition of employment?</h2><p><b>Bartek:</b><span style="font-weight: 400;"> Does the reform change the definition of employment or the criteria for assessing B2B cooperation?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> It should be emphasised that the criteria for employment under the Labour Code remain unchanged. According to the Code, an employment relationship exists when an employee undertakes to perform work of a specified type for an employer, under their direction, and at a place and time designated by the employer, while the employer undertakes to employ the worker for remuneration. The key features are subordination (employer’s direction) and working at a designated place and time. These are the main elements distinguishing employment from B2B cooperation, where the contractor should maintain organisational independence, bear economic risk, and decide on the manner, place, and time of providing services. At the same time, only one of these elements-subordination-is exclusive to employment. The others may also appear in civil law relationships, which shows that in practice the specific circumstances of work performance are crucial.</span></p><h2>Which companies are most exposed to B2B reclassification risk?</h2><p><b>Bartek:</b><span style="font-weight: 400;"> Which companies will be most exposed to the risk of reclassification of B2B cooperation into employment contracts?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> Although formally this should not matter, from a practical point of view, the risk of reclassification will primarily affect companies with organisational units located in the Republic of Poland.</span></p><p><span style="font-weight: 400;">Conducting proceedings against entities registered abroad may require determining jurisdiction, serving documents internationally, and using international cooperation mechanisms, including enforcement of decisions, which complicates and prolongs the process.</span></p><p><span style="font-weight: 400;">In light of the solutions introduced by the PIP reform, practical doubts may still arise in situations where a contractor provides services directly to a foreign entity without a branch or subsidiary in Poland. In this context, it is worth noting a systemic change: the introduction of enhanced information exchange mechanisms between the Labour Inspectorate, the Social Insurance Institution (ZUS), and the Head of the National Revenue Administration. Entities operating in Poland provide a wide range of data to ZUS and tax authorities, which in practice may form the basis for selecting entities for inspection by PIP. As a result, this intensive data exchange between these authorities may significantly determine which entities are inspected, increasing risk for domestic companies compared to foreign ones.</span></p><p><span style="font-weight: 400;">At the same time, it should be emphasised that establishing the existence of an employment relationship does not automatically make it easy to enforce all its consequences against foreign entities.</span></p><h2>Consequences of B2B reclassification for companies and contractors</h2><p><b>Bartek:</b><span style="font-weight: 400;"> What consequences of reclassification may be felt by companies and contractors themselves?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> Significant consequences of reclassifying a civil law contract into an employment contract will be felt both by companies working with B2B contractors and by the contractors themselves.</span></p><p><span style="font-weight: 400;">The price of gaining employee rights under the law—including protection against dismissal in certain situations, paid vacation, sick pay, and working time regulations—will be a reduction in financial benefits resulting from the need to apply the employment tax and social security regime, particularly regarding different rules of taxation and contributions.</span></p><p><span style="font-weight: 400;">In practice, this means switching to a system where remuneration is subject to income tax advances collected by the payer and full social and health insurance contributions under employment rules.</span></p><p><span style="font-weight: 400;">A change in legal qualification may also lead to disputes between parties regarding the level of remuneration due under an employment relationship.</span></p><h2>How to reduce the risk of B2B reclassification?</h2><p><b>Bartek:</b><span style="font-weight: 400;"> What can organisations do today to reduce the risk related to the new PIP powers?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> When assessing the risk of reclassification into an employment relationship, a company using the B2B model should consider several factors and structure cooperation in a way that does not resemble employment.</span></p><p><span style="font-weight: 400;">Risk mitigation measures include:</span></p><ul><li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">ensuring real independence of the contractor (no detailed instructions on how services are performed and freedom in organising work),</span></li><li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">avoiding fixed working hours and a designated workplace, especially in a manner similar to employment,</span></li><li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">introducing elements of economic risk on the contractor’s side, including responsibility for results,</span></li><li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">defining services in a project-based or task-based manner rather than as ongoing duties,</span></li><li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">refraining from granting employee-like benefits.</span></li></ul><h2>What should companies do after the PIP reform?</h2><p><b>Bartek:</b><span style="font-weight: 400;"> What is the most important conclusion for companies using the B2B model?</span></p><p><b>Dariusz:</b><span style="font-weight: 400;"> The new powers of labour inspectors significantly increase the legal risk borne by organisations and individuals providing services under non-employment forms of cooperation. Supervisory authorities will examine much more closely the boundary between flexible forms of cooperation and the circumvention of labour law.</span></p><p><span style="font-weight: 400;">Ultimately, only a real, consistent, and well-structured distinction between B2B and employment can reduce the risk of reclassification.</span></p><h2>The future of B2B: Building teams that work</h2><p><span style="font-weight: 400;">From the perspective of the IT market, I do not expect the end of the B2B model.</span></p><p><span style="font-weight: 400;">What I do expect is the end of cooperation models that for years functioned like employment contracts, just under a different name.</span></p><p><span style="font-weight: 400;">B2B remains attractive for both companies and specialists. It provides flexibility, speed of action, and the ability to build cooperation based on specific competencies and results. However, the new regulations clearly show that the legislator will examine much more carefully situations in which the form of cooperation does not reflect its actual nature.</span></p><p><span style="font-weight: 400;">Therefore, in the second half of 2026, the key issue will not be what we call the cooperation, but how we actually organise it.</span></p><p><span style="font-weight: 400;">Companies that consciously build contractor relationships and can demonstrate the contractor’s independence will still be able to benefit from B2B. However, the risk will increase for organisations that use B2B contracts to carry out work that in practice has the characteristics of an employment relationship.</span></p><p style="text-align: left;"><span style="font-weight: 400;">Therefore, the most important question today is not:</span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;"> “Will B2B survive?”</span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;"> but rather:</span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;"> “Is our cooperation model truly B2B?”</span></p>								</div>

									<h2 data-path-to-node="2">New Anti-Mobbing Regulations 2026 &#8211; What Will Change in the Labor Code?</h2><p> </p><p data-path-to-node="3"><b data-path-to-node="3" data-index-in-node="0">Bartek:</b> <strong>There has been a lot of talk recently about changes in labor law regulations aimed at making it easier for employees to win court cases involving discrimination or mobbing. Should the new regulations actually be interpreted this way? When will they come into force?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Dariusz:</b> Some of the regulations designed to prevent undesirable workplace behavior are already over 20 years old. In the daily operations of most employers, the duty to ensure equal treatment and prevent discrimination and mobbing is obvious. However, the need to adapt these regulations -both to the modern reality and to the established case law of labor courts -has been signaled for a long time. The Polish government decided to respond to these voices and prepared a draft amendment to the Labor Code in this area. The draft has already been formally submitted to parliament. While we are still talking about proposed legislation, in my estimation, we should expect the new regulations to be passed before the end of 2026.</p><p data-path-to-node="5">The scope of the proposed changes covers two main areas: countering mobbing practices and combating workplace discrimination.</p><p data-path-to-node="6">Above all, the draft introduces a new definition of mobbing. This is indeed intended to make it easier to pursue anti-mobbing claims, which until now have often ended in dismissal on formal grounds due to the procedural difficulties of proving the statutory criteria for mobbing.</p><p data-path-to-node="7">The proposed changes regarding the prevention of discrimination are partly corrective in nature &#8211; for instance, regarding compensation and redress—but they also supplement the definition of discrimination and alter the rules regarding the burden of proof when employees pursue claims.</p><p data-path-to-node="8"><strong>Bartek: That sounds like quite a challenge for companies. Does this mean the new regulations are aimed solely at employers?</strong></p><p data-path-to-node="9"><b data-path-to-node="9" data-index-in-node="0">Dariusz:</b> Undoubtedly, the nature of the changes justifies the claim that the new rules aim to make it easier for employees who are victims of undesirable workplace behavior to pursue claims. However, it is worth emphasizing that the new regulations significantly streamline and clarify the employer&#8217;s position, which should be viewed as a welcome outcome. We must remember that undesirable workplace phenomena have negative consequences both for the individual employee-victim and for the employer as an organization, which in such situations usually faces decreased productivity and increased absenteeism.</p><h2 data-path-to-node="11">Burden of Proof on the Company: How to Avoid Discrimination Accusations?</h2><p> </p><p data-path-to-node="12"><strong>Bartek: How will the employer&#8217;s position in court change in disputes over breaches of the principle of equal treatment in employment?</strong></p><p data-path-to-node="13"><b data-path-to-node="13" data-index-in-node="0">Dariusz:</b> The draft explicitly states that once an employee prima facie establishes (renders plausible) a breach of the principle of equal treatment in employment, the burden of proof shifts to the employer to demonstrate (prove) that no such breach occurred. However, this is not a brand-new concept; it has functioned in court practice for a long time. This change is primarily clarifying in nature. In terms of litigation practice, the position of the parties in a dispute over equal treatment should not change significantly.</p><p data-path-to-node="14">An employee seeking court protection against unequal treatment in employment will be protected against the termination of their employment relationship, meaning retaliatory actions are explicitly forbidden. However, it is worth noting that this broad protection for an employee pursuing their rights in court has clear limits. If an employee knew that no violation had occurred, yet still took action to claim otherwise, such protection will not apply. This solution should limit the risk of abusing available legal instruments in situations where an employee acts in bad faith.</p><h2 data-path-to-node="16">New Definition of Mobbing 2026 – Why Will Proving Harassment Be Easier?</h2><p> </p><p data-path-to-node="17"><strong>Bartek: Does the new definition of mobbing hold practical significance for employers?</strong></p><p data-path-to-node="18"><b data-path-to-node="18" data-index-in-node="0">Dariusz:</b> Without a doubt, yes. Under the current legal framework, an employee wishing to show they were a victim of mobbing had to prove that multiple criteria were met cumulatively. The absence of even one of them resulted in a denial of legal protection. In particular, it was necessary to prove that the mobbing led to a specific outcome &#8211; such as a health disorder, lowered self-esteem, or professional isolation. Proving these circumstances involved significant difficulties, as it often required presenting medical documentation or obtaining expert opinions. As a result, despite objectively unacceptable behavior taking place, successfully pursuing claims was highly difficult for employees and frequently failed. An additional barrier was the need to prove intent on the part of the perpetrator. In practice, it is extremely difficult to establish whether a given behavior was aimed at humiliating an employee or whether it stemmed from an established management style or other organizational factors.</p><p data-path-to-node="19">These circumstances show how significant the hurdles were to successfully proving workplace mobbing. In this context, the proposed change, based on the criterion of persistent harassment, will undoubtedly make it easier for victims of mobbing to pursue their claims.</p><h2 data-path-to-node="21">Penalties for Mobbing in 2026: Is 6 Times the Salary Just the Beginning?</h2><p> </p><p data-path-to-node="22"><strong>Bartek: Does this mean that an employer who has paid damages or redress for mobbing committed by another employee will be able to seek financial recovery from the perpetrator?</strong></p><p data-path-to-node="23"><b data-path-to-node="23" data-index-in-node="0">Dariusz:</b> If mobbing by another employee did indeed take place, an employer who has paid damages or redress to the aggrieved employee will be entitled to pursue so-called recourse claims against the perpetrator to recover the loss incurred. Depending on the perpetrator&#8217;s basis of employment, the employer will be able to pursue claims based either on the provisions of the Labor Code (in the case of an employment relationship) or the Civil Code (in the case of cooperation based on civil law contracts, e.g., a mandate contract). The drafted regulations refer explicitly to the first of these scenarios. Here, too, the legislator clearly aims to balance the interests of the parties. On one hand, it strengthens protection for the employee-victim, who can count on less hesitation from the employer in paying out due benefits. On the other hand, it protects the employer&#8217;s interests by allowing them to demand reimbursement of the paid amounts from the perpetrator.</p><p data-path-to-node="24">This has a significant impact on the employer&#8217;s financial situation, particularly in the context of the sanctions provided for in the draft legislation. An employee who has suffered mobbing will be able to seek not only damages but also non-material redress, the amount of which has been set at no less than six times the minimum wage. Therefore, while the employer remains directly liable to pay these amounts to the employee-victim, the proposed regulations grant them the option to transfer the economic burden to the perpetrator of the violation.</p><p data-path-to-node="25"><b data-path-to-node="25" data-index-in-node="0">Bartek:</b> What if a given behavior does not meet the criteria of persistence? Can an employee still count on protection in such a scenario?</p><p data-path-to-node="26"><b data-path-to-node="26" data-index-in-node="0">Dariusz:</b> The drafters have provided a solution whereby, in the absence of the criteria for mobbing, the labor court should <i data-path-to-node="26" data-index-in-node="123">ex officio</i> (on its own initiative) examine whether the employee&#8217;s personal rights (<i data-path-to-node="26" data-index-in-node="206">dobra osobiste</i>) have been violated. This would mean that even if the behavior does not meet the persistence threshold, the employee is not stripped of legal protection. However, it must be emphasized that the draft is still at the parliamentary stage, and this proposed solution raises significant procedural doubts. In particular, it is pointed out that shaping the court&#8217;s powers this way could constitute a departure from the adversarial principle of civil proceedings, given that the court &#8211; rather than the parties &#8211; would initiate the examination of a matter not covered by the claims in the lawsuit. Additionally, systemic doubts arise. Cases involving the violation of personal rights generally fall under the jurisdiction of regional courts (<i data-path-to-node="26" data-index-in-node="953">sądy okręgowe</i>), whereas labor law cases are handled by district courts (<i data-path-to-node="26" data-index-in-node="1025">sądy rejonowe</i>). Adopting the proposed solution would therefore lead to a certain inconsistency in court jurisdiction.</p><p data-path-to-node="27">Regardless of these reservations, the direction of the changes is clear &#8211; the legislator aims to ensure protection for the employee even in situations that do not meet the statutory definition of mobbing but still constitute a violation of their personal rights. On this point, however, I recommend patience to see what the final shape of the regulations will look like.</p><h2 data-path-to-node="29">Active Prevention Instead of &#8220;Paper&#8221; Procedures</h2><p> </p><p data-path-to-node="30"><b data-path-to-node="30" data-index-in-node="0">Bartek:</b> <strong>In light of the new regulations, will employers have to adopt additional anti-mobbing policies?</strong></p><p data-path-to-node="31"><b data-path-to-node="31" data-index-in-node="0">Dariusz:</b> The drafted regulations clearly emphasize that the obligation to counteract mobbing cannot be purely formal. Employers will be required to take active and continuous measures &#8211; meaning actions that genuinely aim to prevent the occurrence of undesirable behavior in the workplace. This marks a departure from the practice seen so far, where this duty was fulfilled primarily by introducing internal regulations that often carried limited practical weight. Merely adopting an anti-mobbing procedure will not suffice if it is not actually applied and enforced. The active nature of this duty should be understood as the necessity to take preventative actions, such as training employees and management, building awareness of unacceptable behavior, and creating safe reporting channels for irregularities. It must be stressed that these actions cannot be incidental; they must be part of a sustained and systemic approach to organizational management.</p><p data-path-to-node="32"><b data-path-to-node="32" data-index-in-node="0">Bartek:</b> <strong>So prevention is one thing, but what happens if a specific report comes in despite the training? Will simply having a procedure be enough?</strong></p><p data-path-to-node="33"><b data-path-to-node="33" data-index-in-node="0">Dariusz:</b> In practice, how an employer responds to reports will become highly significant. A failure to carry out adequate explanatory investigations, or conducting them merely for appearances, could be judged as a failure to fulfill the duty to counteract mobbing &#8211; regardless of whether mobbing is ultimately found to have occurred. The proposed changes therefore elevate the standard of due diligence required of employers. The focal point shifts from the mere existence of regulations to their actual functioning. Importantly, the choice of methods and tools remains at the employer&#8217;s discretion. Consequently, it is not so much the content of the procedures, but rather their effectiveness and practical application that will be evaluated &#8211; both in terms of employer liability and potential court disputes.</p><h2 data-path-to-node="35">How to Prepare Your Company for the Changes in 2026? Workplace Culture as a Recruitment Advantage in IT</h2><p> </p><p data-path-to-node="36">My conversation with <a href="https://www.linkedin.com/in/dariusz-zimnicki-99ba93112/"><span style="color: #0000ff;"><strong>@Dariusz Zimnicki</strong></span></a> shows that the upcoming amendment is not just cosmetic legal fine-tuning, but a clear signal to the labor market. 									<h2><span style="font-size: 18pt;">Nowe przepisy antymobbingowe 2026 &#8211; co zmieni się w Kodeksie pracy?</span></h2><p><b>Bartek: </b><strong>Wiele mówi się ostatnio o zmianach w przepisach prawa pracy, które mają ułatwić pracownikom wygrywanie spraw sądowych w przypadku dyskryminacji lub stosowania mobbingu. Czy faktycznie tak trzeba interpretować nowe przepisy? Kiedy nowe przepisy wejdą w życie?</strong></p><p><b>Dariusz: </b><span style="font-weight: 400;">Niektóre przepisy mające zapobiegać niepożądanym zjawiskom w pracy mają już ponad 20 lat. W codziennej praktyce funkcjonowania większości pracodawców, kwestie obowiązku zapewnienia równego traktowania czy zapobiegania dyskryminacji i mobbingowi są oczywiste. Od dawna sygnalizowana jest jednak potrzeba dostosowania tych przepisów, zarówno do nowej rzeczywistości, jak też do dorobku orzeczniczego sądów pracy. Polski rząd zdecydował się zareagować na te głosy i przygotował projekt nowelizacji przepisów kodeksu pracy w tym zakresie. Projekt formalnie został już skierowany do prac w parlamencie. Wciąż trzeba mówić o projektowanych zmianach, w mojej ocenie należy jednak spodziewać się, że nowe przepisy zostaną uchwalone jeszcze w 2026 roku.</span></p><p><span style="font-weight: 400;">Zakres proponowanych zmian dotyczy dwóch kwestii: przeciwdziałaniu praktykom mobbingowym oraz dyskryminacji w miejscu pracy.</span></p><p><span style="font-weight: 400;">Projekt wprowadza przede wszystkim nową definicję mobbingu, co ma rzeczywiście ułatwiać dochodzenia roszczeń antymobbingowych, które dotychczas często kończyły się na oddaleniu roszczenia z powodów formalnych, wynikających z trudności procesowych dotyczących udowodnienia ustawowych przesłanek mobbingu.</span></p><p><span style="font-weight: 400;">Proponowane zmiany w części dotyczącej zapobiegania dyskryminacji mają po części charakter porządkujący, choćby w zakresie odszkodowania i zadośćuczynienia, ale zawierają także uzupełnienie definicji dyskryminacji oraz zmiany zasady dotyczącej ciężaru dowodu przy dochodzeniu roszczeń przez pracowników.</span></p><p><b>Bartek:</b><strong> To brzmi jak spore wyzwanie dla firm. Czy to oznacza, że nowe przepisy są wymierzone wyłącznie w pracodawców?</strong></p><p><span style="font-weight: 400;"><strong>Dariusz:</strong> Niewątpliwie charakter zmian uzasadnia twierdzenie, że nowe przepisy mają na celu ułatwienie dochodzenia roszczeń pracownikom, będących ofiarami niepożądanych zjawisk w miejscu pracy. Warto jednak podkreślić, że nowe przepisy istotnie porządkują i klarują sytuację pracodawcy co należy uznać za pożądany efekt zmian. Trzeba pamiętać, że niepożądane zjawiska w pracy przynoszą negatywne skutki zarówno w sferze indywidualnego pracownika-ofiary, jak też pracodawcy jako organizacji, która w takich sytuacjach najczęściej mierzy się z problemem obniżonej wydajności pracy i zwiększonej absencji.   </span></p><h2>Ciężar dowodu po stronie firmy:  Jak uniknąć oskarżeń o dyskryminację?</h2><p><b>Bartek: </b><strong>W jaki sposób zmieni się sytuacja pracodawcy przed sądem w sporach o naruszenie zasady równego traktowania w zatrudnieniu?</strong></p><p><b>Dariusz:</b><span style="font-weight: 400;"> Projekt wprost wskazuje, że uprawdopodobnienie przez pracownika faktu naruszenia zasady równego traktowania w zatrudnieniu skutkuje przerzuceniem na pracodawcę ciężaru wykazania (udowodnienia), że do takiego naruszenia nie doszło. Nie jest to jednak nowe rozwiązanie, w praktyce sądowej funkcjonuje ono od dawna. Zmiana ta ma przede wszystkim charakter porządkujący, w praktyce procesowej, pozycja stron w sporze o naruszenie zasady równego traktowania nie powinna ulec istotnej zmianie.</span></p><p><span style="font-weight: 400;">Pracownik dochodzący przed sądem ochrony przed nierównym traktowaniem w zatrudnieniu będzie chroniony przed rozwiązaniem stosunku pracy, działania odwetowe są więc wprost zakazane. Warto jednak zwrócić uwagę na to, że szeroka ochrona pracownika dochodzącego swoich praw przed sądem ma wyraźne granice. Jeśli pracownik wiedział, że do naruszenia nie doszło, a mimo to podejmował działania zmierzające do jego wykazania to wspomniana ochrona mu nie przysługuje. Takie rozwiązanie powinno ograniczyć ryzyko nadużywania dostępnych instrumentów prawnych w sytuacjach, gdy pracownik działa w złej wierze.</span></p><h2>Nowa definicja mobbingu 2026 &#8211; dlaczego udowodnienie nękania będzie łatwiejsze?</h2><p><b>Bartek: </b><strong>Czy nowa definicja mobbingu ma praktyczne znaczenie dla pracodawców?</strong></p><p><b>Dariusz: </b><span style="font-weight: 400;">Bez wątpienia tak. W dotychczasowym stanie prawnym pracownik chcący wykazać, że stał się ofiarą mobbingu, musiał udowodnić kumulatywne spełnienie wielu przesłanek. Brak wystąpienia choćby jednej z nich prowadził do pozbawienia ochrony prawnej z tego tytułu. W szczególności konieczne było wykazanie, że mobbing doprowadził do określonego skutku – takiego jak rozstrój zdrowia, obniżona samoocena czy izolacja zawodowa. Udowodnienie tych okoliczności wiązało się ze znacznymi trudnościami, gdyż często wymagało przedstawienia dokumentacji medycznej lub uzyskania opinii biegłych. W efekcie, mimo występowania obiektywnie nieakceptowalnych zachowań, skuteczne dochodzenie roszczeń przez pracowników było istotnie utrudnione i niejednokrotnie kończyło się niepowodzeniem. Dodatkową barierą była konieczność wykazania zamiaru po stronie sprawcy. W praktyce niezwykle trudno ustalić, czy dane zachowanie było ukierunkowane na poniżenie pracownika, czy też wynikało z przyjętego stylu zarządzania lub innych przesłanek organizacyjnych.</span></p><p><span style="font-weight: 400;">Powyższe okoliczności pokazują, jak istotne przeszkody stały na drodze do skutecznego wykazania mobbingu w miejscu pracy. W tym kontekście proponowana zmiana, oparta na przesłance uporczywego nękania, bez wątpienia ułatwi ofiarom działań mobbingowych dochodzenie roszczeń.</span></p><h2>Kary za mobbing w 2026 roku: 6-krotność pensji to dopiero początek?</h2><p><b>Bartek: </b><strong>Czy to oznacza, że pracodawca, który zapłacił odszkodowanie lub zadośćuczynienie z tytułu mobbingu dokonanego przez innego pracownika, będzie mógł dochodzić wyrównania szkody od sprawcy?</strong></p><p><b>Dariusz: </b><span style="font-weight: 400;">Jeżeli faktycznie doszło do mobbingu ze strony innego pracownika, pracodawca, który wypłacił pokrzywdzonemu pracownikowi odszkodowanie lub zadośćuczynienie, będzie uprawniony do dochodzenia od sprawcy tzw. roszczeń regresowych, czyli wyrównania poniesionej szkody. W zależności od podstawy zatrudnienia sprawcy mobbingu, pracodawca będzie mógł dochodzić roszczeń na podstawie przepisów Kodeksu pracy (w przypadku stosunku pracy) albo na podstawie przepisów Kodeksu cywilnego (w przypadku współpracy na podstawie umów cywilnoprawnych, np. umowy zlecenia). Projektowane przepisy odnoszą się wprost do pierwszej z tych sytuacji. Również w tym przypadku ustawodawca wyraźnie dąży do wyważenia interesów stron. Z jednej strony wzmacnia ochronę pracownika będącego ofiarą mobbingu, który może liczyć na mniejszą wstrzemięźliwość pracodawcy w wypłacie należnych świadczeń. Z drugiej strony zabezpiecza interes pracodawcy, umożliwiając mu dochodzenie zwrotu wypłaconych kwot od sprawcy naruszenia.</span></p><p><span style="font-weight: 400;">Powyższe ma istotne przełożenie na sytuację ekonomiczną pracodawcy, w szczególności w kontekście przewidzianych w projekcie ustawy sankcji. Pracownik, który doznał mobbingu, oprócz odszkodowania, będzie mógł dochodzić również </span>zadośćuczynienia, którego wysokość została określona na poziomie nie niższym niż sześciokrotność minimalnego wynagrodzenia za pracę<b>.</b><span style="font-weight: 400;"> O ile więc pracodawca nadal pozostaje bezpośrednio zobowiązany do spełnienia tych świadczeń wobec pracownika-ofriay, o tyle projektowane przepisy przyznają mu możliwość przeniesienia ciężaru ekonomicznego na sprawcę naruszenia. </span></p><p><b>Bartek:</b><strong> A co w przypadku, gdy jednak dane zachowanie nie będzie nosiło znamienia uporczywości? Czy w takiej sytuacji pracownik będzie mógł liczyć na ochronę?</strong></p><p><b>Dariusz: </b><span style="font-weight: 400;">Projektodawcy przewidzieli rozwiązanie, zgodnie z którym w przypadku braku spełnienia przesłanek mobbingu sąd pracy powinien z urzędu zbadać, czy nie doszło do naruszenia dóbr osobistych pracownika. Oznaczałoby to, że nawet jeżeli zachowanie nie spełnia kryterium uporczywości, pracownik nie zostaje pozbawiony ochrony prawnej. Należy jednak podkreślić, że projekt znajduje się nadal na etapie prac parlamentarnych, a proponowane rozwiązanie budzi istotne wątpliwości natury procesowej. 									<h2>Dlaczego model „jeden dla wszystkich” w zarządzaniu IT zawodzi?</h2><p> </p><p><b>Bartek: </b><strong>Zarządzałaś HR-em w krajach o zupełnie innym podejściu do pracy. Czy w czasach, gdy cały rynek IT szuka oszczędności i efektywności, da się stworzyć jeden model zarządzania dla tak różnych kultur, czy musisz szyć go na miarę, uwzględniając różną odporność tych rynków na kryzys?</strong></p><p><b>Ola: </b><span style="font-weight: 400;">Zdecydowanie trzeba szyć na miarę, ale w oparciu o jasne pryncypia globalne. </span><span style="font-weight: 400;">Wszelkie próby centralizowania procesów, polityk i systemów, z którymi do tej pory miałam okazję się spotkać, lub które współtworzyłam ostatecznie nie wytrzymywały próby czasu. To co początkowo miało się sprawdzić i skalować wraz z dojrzewaniem organizacji po prostu nie dawało rady, a lokalne zespoły HR wraz z liderami głowiły się nad znalezieniem remedium. </span></p><p><span style="font-weight: 400;">W najtrudniejszym położeniu jest w takiej sytuacji lider opiekujący zespoły w kilku krajach, a w obecnych matrixowych strukturach mamy przecież takich wielu. Dajmy dla przykładu sytuację, w której firma realizuje globalny program stażowy i ustala odgórnie zasady np. jasno określając pensję na start dla takiego Software Engineera. W Hiszpanii minimalna pensja po stażu we współpracy z uczelnią jest określona w przepisach; w Polsce większość pracujących i studiujących do 26 roku życia korzysta z PIT 0 i preferuje umowę zlecenia, a w takiej Szwecji praktyką jest organizowanie stażów bezpłatnych w zamian za możliwość napisania pracy dyplomowej na bazie odbytego stażu, zdobytych danych i wiedzy. </span></p><p><span style="font-weight: 400;">W mojej ocenie mądre jest tylko ustalenie pryncypiów na poziomie globalnym, a następnie pozwolenie lokalnym oddziałom na dopracowanie rozwiązań, które będą się sprawdzać na rodzimym rynku pracy, jak sam to określiłeś, będą odporne na kryzys tym samym pozwalając liderom zarządzać zespołami mądrze i długofalowo.</span></p><p><strong>Bartek:  Co w takim razie najczęściej „rozbija” te uniwersalne, globalne polityki w praktyce?</strong></p><p><span style="font-weight: 400;"><br /></span><b>Ola: </b><span style="font-weight: 400;">Dwa obszary bywają przez organizacje niedoszacowane przy globalnych wdrożeniach, a są to różnice kulturowe i zmiany w krajowych przepisach prawnych &#8211; to one łamią uniwersalne polityki. Szczególnie ten drugi obszar choć wydawałoby się uspójniony wysiłkami Unii Europejskiej przynosi wyzwania w postaci tego jak ‘pożenić’ globalne polityki z lokalnymi wymogami prawnymi. </span></p><p><strong>Bartek: Czy masz jakiś konkretny przykład rynku, gdzie te różnice są najbardziej jaskrawe?</strong></p><p><b>Ola:</b><span style="font-weight: 400;"> Największe doświadczenie mam w pracy z rynkiem szwedzkim, który diametralnie różni się od rynku pracy w Polsce. Po pierwsze jest to rynek wysoce uzwiązkowiony, i w zasadzie nie ma znaczenia czy spółka ma podpisane porozumienie zbiorowe (CBA) czy też nie, większość pracowników i tak należy do jakiegoś związku zawodowego, z którym pracodawca przy większych zmianach organizacyjnych ma obowiązek skonsultować się, co znacznie wpływa na to jakie rozwiązania możemy wdrożyć. </span></p><p><span style="font-weight: 400;">W przypadku polskich firm IT aspekt związkowy jest w zasadzie pomijalny, niemniej jednak jestem zdania, że ze względu na ciągłe zmiany makroekonomiczne w regionie jest to kierunek, do którego zmierzamy. Model zarządzania, musi być dostosowany do lokalnych norm i regionalnych praktyk tak aby trwał i pozwalał na retencję pracowników, a co za tym idzie ciągłość biznesową.</span></p><h2>Koszty pracy i outsourcing IT: Czy Kraków przegra z Bałkanami w 2026 roku? </h2><p> </p><p><strong>Bartek: Gdzie w tym wszystkim widzisz Polskę i Kraków? Czy w dobie racjonalizacji zatrudnienia w Europie, Kraków wciąż jest postrzegany jako bezpieczna przystań i serce operacyjne, które gwarantuje najwyższą jakość?</strong></p><p><b>Ola: </b><span style="font-weight: 400;">Kraków jako ośrodek IT i high tech stoi wysoko w rankingach, a nasi inżynierowie mają renomę na skalę światową. W dobie racjonalizacji zatrudnienia, aspekt kosztowy jest jednak kluczowy a tutaj już mamy konkurencję w postaci Bałkanów. </span></p><p><span style="font-weight: 400;">Ostatnie dwie dekady to czas kiedy my dowiedliśmy, że warto w Polsce lokować kapitał i rozwijać zespoły inżynierskie ze względu na jakość i etykę pracy, już niekoniecznie na niskie koszty. Czy Rumunia, Grecja, Bułgaria i Cypr wybronią się tak jak my, zachowując przy tym niższe koszty pracy pokaże najbliższe dziesięciolecie. </span></p><p><span style="font-weight: 400;">Na pewno zachodni kapitał spogląda w tamtym kierunku; ja jednak o przyszłość krakowskich software house’ów się nie boję &#8211; żadna z kultur, z którymi pracowałam nie reagowała i adaptowała się tak szybko do zmian jak my, żadna też nie była nastawiona na usprawnianie własnej pracy jak my Polacy. </span></p><p><span style="font-weight: 400;">Pracuję z kolegami z kilku krajów (Anglii, Francji, Hiszpanii, Bułgarii, Grecji czy wymienionej już wcześniej Szwecji) i w mojej ocenie,</span> <span style="font-weight: 400;">to właśnie my Polacy, najszybciej wdrażamy również narzędzia AI</span> <span style="font-weight: 400;">w swojej codziennej, ale i typowo projektowej pracy.</span></p><h2>Efektywność AI w zespołach IT &#8211; jak uniknąć „pracy dwóch prędkości”?</h2><p> </p><p><strong>Bartek: W 2026 AI to standard. Czy jako Head of HR widzisz AI jako narzędzie, które odciąża ludzi, czy raczej jako czynnik, który wymusza na nas bolesną ewolucję ról zawodowych?</strong></p><p><b>Ola: </b><span style="font-weight: 400;">W kontekście pracy umysłowej, w międzynarodowym środowisku, AI umiejętnie użyty znacznie odciąży wszystkich pracowników bo naprawdę na każdym stanowisku są obowiązki z kategorii tych powtarzalnych i niekoniecznie rozwijających nas. Tak zwani “early adopters” nie myślą nawet w kategoriach tego, że AI “wymusza” ewolucję ich ról, a wręcz odwrotnie &#8211; korzystają z asystentów aby świadomie zmieniać naturę swojej pracy i kształtować swoją codzienność w pracy. </span></p><p><span style="font-weight: 400;">To ogromny przywilej mieć narzędzia pozwalające zminimalizować albo nawet całkowicie wyrugować prace rutynowe, te których nie lubimy i na, które zawsze narzekaliśmy przy porannej kawie. Koniec z malkontenctwem. </span></p><p><strong>Bartek: Brzmi jak ideał, ale czy w dużych organizacjach to przejście jest tak płynne?</strong></p><p><b>Ola: </b><span style="font-weight: 400;">Wyzwanie, z którym się mierzę aktualnie jest nieco inne. Mamy w organizacjach nierówny poziom adaptacji narzędzi typu AI, zarówno na poziomie działów, jak i jednostek &#8211; to znaczy mamy działy, którym jakoś z AI mniej po drodze, i te, które przodują w wykorzystaniu. </span></p><p><span style="font-weight: 400;">Naturalną konsekwencją jest praca dwóch prędkości a to rodzi trudności w zarządzaniu wspólnymi wdrożeniami i projektami, rodzi frustrację wśród tych, którzy z AI są już za pan brat. Jako liderzy natomiast, konkretnie wskazywać gdzie i w jakim kontekście sami użyliśmy narzędzi, podsumowywać czego i ile zaoszczędziliśmy dzięki AI, ale także gdzie trafiliśmy na pułapki, aby inni mogli korzystać z naszego przykładu. Tylko transparentna i wyważona narracja pozwoli znormalizować użycie AI w pracy i przekonać do niej sceptyków a tego przecież chce organizacja inwestująca niemałe środki w korporacyjne licencje. </span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;">Myślę, że szczególnie w tej wstępnej fazie wdrożenia narzędzi tego typu warto trochę na kształt przypisów &#8211; odwołań, które stosuje się w pracach dyplomowych zaznaczać konkretnie co zostało wykonane przy pomocy AI, tak aby pozostali, szczególnie Ci mniej obyci, potrafili rozróżnić pracę naszą od pracy przez nas zleconej asystentom AI. </span></p><p><span style="font-weight: 400;">Wzrost efektywności w pracy jest ewidentny i niepodważalny. Z perspektywy HRowca bardziej interesuje mnie jak ta AI’owa rewolucja wpłynie na standardowe procesy performance managementowe, ci będący forpocztą zmian na pewno nie stracą.</span></p><h2>Work-life integration w branży IT:  Jak inżynierowie adaptują się do zmian na rynku pracy?</h2><p> </p><p><strong>Bartek: Work-life integration zamiast Work-life balance &#8211; czy w branży, która mierzy się z taką presją rynkową, to w ogóle możliwe, czy to model tylko dla wybranych?</strong></p><p><b>Ola:</b><span style="font-weight: 400;"> „Taką presją rynkową, Bartku?” Branża IT rzeczywiście przechodzi okresowe korekty zatrudnienia &#8211; to trudne doświadczenie, ale nieuniknione w cyklu rynkowym, mierzą się z nim niemal od zawsze inne sektory. Jeżeli w londyńskim oddziale normą jest w trakcie dnia wychodzić na godzinny lunch i siłownię, a tym samym spędzać w biurze 10h+ to kogoś, kto ceni sobie zamknięcie komputera o 16 taki model będzie uwierał i generował dodatkowy stres. Firmy są dość transparentne w kontekście tego jaki model jest akceptowalny, więc na etapie zatrudnienia warto upewnić się, że jest zgodny z naszymi preferencjami.</span></p><h2>Współpraca z agencją rekrutacyjną IT &#8211; od rekrutacji do twardego konsultingu HR</h2><p> </p><p><strong>Bartek: Patrząc z perspektywy czasu na rozwój Ocado w Polsce, a mieliśmy okazję wspierać Was na tym etapie niemal od pierwszych dni &#8211; co Twoim zdaniem było kluczowe w budowaniu tego fundamentu?</strong></p><p><b>Ola: </b><span style="font-weight: 400;">Nigdy nie ściągaliśmy odpowiedzialności z liderów, nie wyręczaliśmy a po partnersku budowaliśmy relacje z Nimi. Do these forecasts carry any weight? Is AI truly a threat to software developers?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Marcin:</b> I think the rumors of the developer profession&#8217;s demise are rather exaggerated. I recently read an insightful interview with Sundar Pichai (CEO of Alphabet), who views artificial intelligence as an accelerator for productivity and innovation. I agree with him on this point. AI gives us the opportunity to greenlight projects that, until recently, were shelved for being unprofitable or too time-consuming. Companies will want to launch far more of them, which, paradoxically, will increase the demand for talent.</p><p data-path-to-node="5">However, we must honestly admit that the role of the developer is shifting heavily under the influence of AI. What’s more, this transformation is happening incredibly fast.</p>								</div>

Can they be trusted with production tasks yet?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Marcin:</b> While a year ago we looked at an AI model as a talented junior who needed their hand held, today it is much closer to a senior-level partner. Thanks to large context windows, models can &#8220;see&#8221; the entire project, spot architectural patterns, and generate cohesive solutions.</p><p data-path-to-node="5">However, I would like to draw a sharp line here: it is a very specific type of senior. It possesses immense technical knowledge, but zero business intuition and no sense of consequence. It is still a powerful machine, not a human being.</p><p data-path-to-node="6">Because of this, the developer&#8217;s role is shifting from a &#8220;craftsman&#8221; who writes code to a &#8220;conductor&#8221; and verifier. Artificial intelligence can handle most of the grunt work, but it is the human who must define the goal, break it down into meaningful tasks, and &#8211; most importantly &#8211; take responsibility for the outcome. A model will generate a solution, but it won&#8217;t take an on-call shift for a developer, nor will it answer to the board for a production outage.</p>								</div>

For years, we have been building &#8220;smart&#8221; features &#8211; utilizing advanced algorithms and machine learning to optimize logistics, power shopping recommendations, or control the robots in our warehouses. For our engineers, working with intelligent algorithms is standard practice, not a novelty.</p><p data-path-to-node="5">What <i data-path-to-node="5" data-index-in-node="5">has</i> changed recently, however, is that we have given this a strategic framework. We treat AI as a priority both at the company-wide level and within my department. We created a concrete strategy that outlines two clear directions of action: supporting product innovation and improving the &#8220;developer experience.&#8221; We want AI to take tedious, repetitive tasks off developers&#8217; plates and support them in making design decisions.</p><p data-path-to-node="6">Thanks to this approach, the discussion within teams isn&#8217;t about <i data-path-to-node="6" data-index-in-node="65">whether</i> it&#8217;s worth it, but <i data-path-to-node="6" data-index-in-node="92">how</i> to use it wisely.</p><p data-path-to-node="7"><strong>Bartek: And that is a crucial point from a recruitment perspective. We are increasingly seeing that a mere list of technologies on a CV is no longer a sufficient indicator of quality. Today, it is far more important whether an engineer can take ownership of a product and understand the business context of their decisions. You can&#8217;t verify that with a simple framework proficiency test.</strong></p><p data-path-to-node="8"><b data-path-to-node="8" data-index-in-node="0">Marcin:</b> Exactly. This is happening because the barrier to entry into a specific technology has lowered significantly &#8211; especially for people with extensive general experience.</p><p data-path-to-node="9">The best proof of this is the fact that in our company, managers are returning to working with code. This is a group that has a great understanding of the business but had moved away from daily coding over the years. AI allows these individuals to get back in the game. It lifts the burden of fighting with syntax or knowing libraries inside out, allowing them to dive deeper into the project. As a result, leaders are once again closer to the problems being solved.</p><p data-path-to-node="10">In this context, skepticism toward AI in 2026 is no longer &#8220;healthy caution&#8221; but a lack of a core competency. It’s a bit like insisting on digging with a shovel when there’s an excavator sitting right next to you &#8211; you can still work that way, but you are drastically limiting your capabilities.</p><p data-path-to-node="11">That is why, in order not to leave people facing this challenge alone, we have focused on systemic education. We encourage training &#8211; including in &#8220;spec-driven development&#8221; &#8211; and provide access to professional tools like Cursor or Copilot, while continuously developing the knowledge base for our internal AI assistant.</p></div></div>								</div>

									<h2 data-path-to-node="2">The role of the Technical Leader in the AI era</h2><p data-path-to-node="3"> </p><p data-path-to-node="3"><strong>Bartek: Since the barrier to entry into technology has lowered, where is the weight of a leader&#8217;s responsibility shifting today?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Marcin Zięba:</b> I mentioned leaders diving deeper into projects. Today, this has already become a standard expectation in most organizations. We see value in a leader genuinely understanding the matter their team is working on. Thanks to this architectural knowledge, the leader becomes a true partner for the business &#8211; they are able to answer stakeholders&#8217; questions on the fly, instead of ending every conversation with the phrase: &#8220;I&#8217;ll get back to you, I just need to check with the team.&#8221;</p><p data-path-to-node="5">The shift we are experiencing is happening at record speed, and for many people, it is simply overwhelming. Above all, a leader today must provide support during this process: they must look out for the team’s well-being and guide the wise development of competencies, ensuring that no one feels left behind by the breakneck pace of technology.</p><p data-path-to-node="6"><strong>Bartek: Looking out for well-being and development sounds like a purely &#8220;human&#8221; challenge, but I imagine technology can practically support leaders here. How does this translate into concrete actions within the team?</strong></p><p data-path-to-node="7"><b data-path-to-node="7" data-index-in-node="0">Marcin Zięba:</b> At the single-team level, it can mean encouraging people to use AI for daily tasks, implementing automated code reviewers, or building knowledge bases from your own documentation to feed a local model or a company RAG system. These are tangible benefits that save time, for instance, in support workflows.</p><p data-path-to-node="8">On the other hand, at the multi-team level, the manager’s weight of responsibility shifts from &#8220;delivery management&#8221; to ecosystem design. It becomes crucial to build a culture of innovation where there is permission to experiment &#8211; including failures &#8211; and space to exchange knowledge. I operate on the assumption that if a team doesn&#8217;t &#8220;fail forward&#8221; when trying to apply AI, it means they aren&#8217;t learning fast enough. Many companies are afraid of so-called shadow IT, meaning employees using tools on their own initiative.</strong></p><p data-path-to-node="10"><b data-path-to-node="10" data-index-in-node="0">Marcin Zięba:</b> This is a serious challenge. Naturally, the foundation must be commercial licenses that protect our intellectual property and ensure GDPR compliance. We must continuously educate our people and sensitize them so they understand why they cannot paste company code or data into public, free tools.</p><p data-path-to-node="11">Conversely, shadow IT is often a signal that people have found a better, faster way to work—the company just hasn&#8217;t caught up yet. Instead of fighting grassroots initiatives, a leader should &#8220;civilize&#8221; and scale them. As technical professionals, we have the competencies to assess the risk and formulate a recommendation for the company.</p><p data-path-to-node="12">A prime example from my department is the use of a local Whisper model. It supports our UX researchers in analyzing recordings from user sessions. Automated transcription saves them an immense amount of time that used to be wasted on manual note-taking. Because the model runs locally on the laptop, the data never leaves the company and remains secure. In this way, we turned a potential &#8220;grey area&#8221; into an official, secure working standard.</p>								</div>

If an engineer cannot break a problem down into logical steps and provide the necessary context, the AI will generate working code&#8230; that solves the wrong problem.</p><p data-path-to-node="5">The second aspect is technical intuition. We must remember that models are not thinking entities that &#8220;understand&#8221; architecture in a human way, but rather advanced statistics. We have to rely on our own technical intuition. It allows us to assess whether a model is hallucinating or proposing an unsafe solution. This intuition is what protects us from so-called &#8220;vibe coding&#8221; &#8211; the uncritical acceptance of code simply because, at first glance, it &#8220;looks good.&#8221;</p><p data-path-to-node="6"><b data-path-to-node="6" data-index-in-node="0">Bartek:</b> &#8220;Vibe coding&#8221; usually has a positive connotation &#8211; anyone can build their own app and validate an idea in practice, even without deep technical knowledge. Do you see a danger in this?</p><p data-path-to-node="7"><b data-path-to-node="7" data-index-in-node="0">Marcin:</b> Indeed, you can create great prototypes or Proof of Concepts this way. That has immense value &#8211; the barrier to entry drops, and anyone can quickly check if their idea will catch on. However, the problem arises when we treat such code as production-ready. Solutions generated on the fly by AI rarely meet standards for security and scalability.</p><p data-path-to-node="8">A prime example is the story covered in the media just a few days ago about Mr. Dawid and his KSeF (National e-Invoicing System) integration app. Built with the help of AI, it worked perfectly, and the delighted author shared it with the world &#8211; inadvertently exposing critical company data in the process. Perhaps haste and the desire to show off the solution before anyone else played a part, or perhaps it was simply a lack of experience.</p></div></div>								</div>

Do you have concrete examples of tasks that went from being &#8220;shelved&#8221; to actually completed thanks to AI?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Marcin Zięba:</b> I have a great recent example. We are currently wrapping up rewriting one of our applications to a different tech stack. It was a classic piece of technical debt. The application works fine, but it handles a secondary functionality, so the project kept getting pushed back &#8211; there was always something more urgent.</p><p data-path-to-node="5">One of our managers took on the task. Thanks to AI, he rapidly got up to speed on a new UI framework that he hadn&#8217;t known before. He didn&#8217;t write the code himself, but used his experience to ask the model the right questions about architecture and potential migration pitfalls.</p><p data-path-to-node="6">As a result, we got a realistic feasibility assessment and an action plan. This allowed us to prioritize the work and hand it over to a specialist who, with our support, delivered the project exactly as planned.</p>								</div>

You are touching upon a risk that has been discussed loudly for months. I believe that as an industry, we must actively eliminate this risk. I absolutely do not think that AI will replace juniors. If we stop hiring entry-level developers, in a few years we will wake up with a massive skills gap and a lack of specialists who understand our systems. Today&#8217;s seniors will grow, get promoted, change companies, or retire. This talent renewal process is vital for the survival of businesses.</p><p data-path-to-node="5">Fears that AI will take jobs away from juniors stem from the fact that during the pandemic, IT was hailed as an &#8220;Eldorado,&#8221; which attracted crowds of people hoping for a quick career pivot via &#8220;bootcamps.&#8221; Individuals who entered IT but didn&#8217;t deepen their knowledge are indeed in a difficult position today, because AI is taking over the baseline writing of code.</p><p data-path-to-node="6">Today, the bar is being raised. We are returning to the roots, where solid engineering fundamentals matter—algorithms, data structures, understanding how systems work. This is the baseline that separates someone who merely writes code from an engineer who solves problems. For these juniors—those who are curious and understand <i data-path-to-node="6" data-index-in-node="328">why</i> something works under the hood—there will always be a place.</p><p data-path-to-node="7"><strong>Bartek: It’s essentially a market reality check—we are going back to basics. How, then, do you view the potential of today&#8217;s graduates, who have treated AI as a standard tool since their first year of university?</strong></p><p data-path-to-node="8"><b data-path-to-node="8" data-index-in-node="0">Marcin Zięba:</b> Yes. This reality check filters out accidental people, but on the other hand, we now have access to juniors I would call &#8220;AI-native.&#8221; These are individuals who already use artificial intelligence during their studies, learn machine learning, and train their own models as part of their master&#8217;s theses. This technology is a natural tool for them, not a threat. We are going to need these people.</p><p data-path-to-node="9">The challenge remains in developing the technical intuition I mentioned earlier. We cannot allow juniors to become mere &#8220;prompt operators.&#8221; When it comes down to it, teaching methods here remain old-school. It is still a master-apprentice relationship and close collaboration with seniors. What <i data-path-to-node="9" data-index-in-node="295">does</i> change is the toolkit: a senior no longer has to teach a junior syntax, but they must teach them to read between the lines of AI-generated code and spot errors where something looks seemingly correct.</p><p data-path-to-node="10">As managers, we must create space for this. Succumbing to the narrative that seniors can just &#8220;handle more&#8221; on their own with AI to optimize costs is short-sighted.</p><p data-path-to-node="11"><strong>Bartek: What would be your advice to software developers in 2026?</strong></p><p data-path-to-node="12"><b data-path-to-node="12" data-index-in-node="0">Marcin Zięba:</b> Do not treat AI as a threat, nor as a magical solution to all problems. It is simply another powerful tool in your kit. Experiment without fear, but maintain your critical thinking. Zgadzam się z nim w tej kwestii. AI otwiera nam możliwość realizowania projektów, które jeszcze niedawno były odkładane na półkę jako nieopłacalne albo zbyt czasochłonne. Firmy będą chciały uruchamiać ich znacznie więcej, co paradoksalnie zwiększy zapotrzebowanie na ręce do pracy.</span></p><p><span style="font-weight: 400;">Trzeba jednak uczciwie przyznać, że pod wpływem AI rola programisty mocno się zmienia. Co więcej, ta zmiana przebiega bardzo szybko.</span></p>								</div>

Czy można im już powierzyć zadania produkcyjne?</b></p><p><b>Marcin: </b><span style="font-weight: 400;">O ile rok temu patrzyliśmy na model AI jak na zdolnego juniora, którego trzeba prowadzić za rękę, to dzisiaj bliżej mu do partnera na poziomie seniora. Dzięki dużym oknom kontekstowym modele „widzą” cały projekt, zauważają wzorce w architekturze i generują spójne rozwiązania. </span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;"><br /></span><span style="font-weight: 400;">Natomiast chciałbym postawić tu grubą kreskę: to specyficzny rodzaj seniora. Ma ogromną wiedzę techniczną, ale zerową intuicję biznesową i brak poczucia konsekwencji. To nadal potężna maszyna, a nie człowiek.</span></p><p><span style="font-weight: 400;">Z tego powodu rola programisty zmienia się z „rzemieślnika” piszącego kod w „dyrygenta” i weryfikatora. Proces odnawiania kadr jest niezbędny dla przetrwania firm.</span></p><p><span style="font-weight: 400;">Obawy o to, że AI odbierze pracę juniorom, wynikają z tego, że w czasie pandemii IT okrzyknięto „Eldorado”, co przyciągnęło rzesze ludzi liczących na szybkie przebranżowienie po „bootcampach”. Osoby, które weszły do IT i nie pogłębiły wiedzy, faktycznie są w trudnej sytuacji, ponieważ AI przejmuje pisanie kodu.</span></p><p><span style="font-weight: 400;">Dziś poprzeczka idzie w górę. Recent media reports indicate that work is now underway on a new draft. Is this true?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Dariusz:</b> Yes, at the end of January, a new draft from the Ministry of Family, Labour and Social Policy was published on government websites, representing a continuation of the work on the reform regarding new powers for the National Labour Inspectorate (PIP). Work on this draft is moving rapidly; the interministerial consultation stage has already concluded, and an updated version of the draft bill was published on February 16 and adopted by the Council of Ministers the very next day.</p><p data-path-to-node="5"> </p><p data-path-to-node="5"><strong>Bartek: Does this mean it is certain that the reform will be adopted? When are the new regulations scheduled to come into force?</strong></p><p data-path-to-node="6"><b data-path-to-node="6" data-index-in-node="0">Dariusz:</b> Currently, the formal government stage of working on the draft bill is wrapping up. The draft will then be forwarded to parliament, and after obtaining approval from both chambers, it will be presented to the President for signature. Only after the President signs it can the law be officially published and enter into force. The current wording of the draft indicates a 3-month <i data-path-to-node="6" data-index-in-node="388">vacatio legis</i>, meaning that the new regulations will come into effect 3 months after the law is published. Therefore, we cannot say with absolute certainty that the reform will enter into force, but both the adoption of the draft by the Council of Ministers and the pace of work so far indicate that there is political consensus to pass the new regulations quickly.</p><p data-path-to-node="7">Undoubtedly, the deadlines for meeting the milestones related to funds from the National Recovery Plan (KPO) are playing a role. Adopting these new regulations is a condition for receiving a portion of those funds. However, it is possible &#8211; and in my view, highly likely &#8211; that changes will still be introduced to the draft during the parliamentary stage.</p>								</div>

Has the government actually backed away from the solution that grants labor inspectors the power to reclassify contracts via an administrative decision?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Dariusz:</b> You could say that although the draft adopted by the Council of Ministers on February 17 introduces significant modifications, it is heavily based on the exact same assumptions that formed the foundation of the earlier draft. The most critical aspect of the new regulations is granting PIP inspectors the authority to establish the existence of an employment relationship via an administrative decision in situations where an employment contract should have been concluded. In this regard, the previously adopted concept of equipping PIP with the competence to independently establish an employment relationship has been maintained. Unfortunately, a large portion of employers&#8217; doubts and concerns remain valid.</p><p data-path-to-node="5">The key change compared to the previous draft is undoubtedly how the moment the employment relationship begins is determined. According to the current draft, if an inspector finds during an audit that work is being performed under conditions that necessitate an employment contract, they will either issue a decision establishing the existence of an employment relationship (as a rule, effective from the date the decision is issued) or they will file a lawsuit in court to establish the employment relationship if it is necessary to establish it for a period prior to the issuance of the decision.</p></div></div>								</div>

The regulations do not specify what the exact content of such an inspector&#8217;s order can be. Furthermore, it remains unclear how a company is supposed to comply with, for instance, an order to conclude an employment contract if the B2B contractor is simply not interested in that form of employment.</p><p data-path-to-node="6">While additional grounds for making a decision immediately enforceable have been removed, the drafted regulations explicitly refer to general principles that still allow an inspector to grant such immediate enforceability to a decision. The new draft also introduces procedural changes compared to earlier proposals; for example, an appeal against a decision establishing the existence of an employment relationship is now to be filed directly with the labor court.</p>								</div>

Is this a safe way to validate a cooperation model?</strong></p><p data-path-to-node="4"><b data-path-to-node="4" data-index-in-node="0">Dariusz:</b> The Chief Labour Inspector is to issue individual interpretations regarding the assessment of whether a presented legal relationship constitutes an employment relationship. However, issuing an interpretation will not be possible if an audit or proceeding is already underway against the applicant regarding that specific matter.</p><p data-path-to-node="5">Personally, I have major doubts about how useful the mechanism of an individual interpretation will actually be for companies in these types of cases. Their nature is highly complex, primarily when it comes to the actual, day-to-day execution of the contract. Even at the stage of presenting the applicant&#8217;s position, it is necessary to outline a factual scenario upon which the interpretation will be based. The interpretation will not necessarily protect the applicant effectively during an audit if the inspector evaluates the actual facts differently.</p><p data-path-to-node="6">The issuance of an interpretation does not prevent an inspector from making a different assessment during an audit if the factual circumstances established during that audit differ from what was previously described in the application. Naturally, the issuance of a negative interpretation for a company could also serve as a trigger for PIP to initiate an audit.</p>								</div>

The rational expectation of the business community is to receive clear guidance on how the auditing body (in this case, PIP) will apply the regulations granting them the power to establish an employment relationship, especially in situations where both parties (the company and the contractor) agreed in good faith on the terms of cooperation based on a B2B model.</p>								</div>

The first of these criteria is the most critical, as it is entirely unique to an employment relationship.</p><p data-path-to-node="6">Consequently, giving a company a broad scope of authority to dictate exactly <i data-path-to-node="6" data-index-in-node="77">how</i> B2B contractors must deliver their services will pose a substantial risk in the context of a potential reclassification.</p><p data-path-to-node="7">It is also highly advisable to audit other aspects of the B2B relationship &#8211; particularly regarding perks or clauses that, in an identical or near-identical format, either originate in the Labour Code or are applied uniformly to both employees and contractors alike. Only if such an analysis leads to the conclusion that a B2B relationship contains multiple elements typical of employment &#8211; and where shifting the way contractors deliver services is impossible due to various reasons (often business-related or tied to the operational structure of the corporate group) &#8211; should the company consider changing the form of engagement.</p>								</div>

Until then, entrepreneurs and the lawyers supporting them must rely on existing practices and their own assessment of how well they meet the criteria outlined in the Labour Code.</p><p data-path-to-node="6">The Chief Labour Inspector has repeatedly promised to publish a &#8220;compliance checklist,&#8221; but no such document has materialized so far. A working draft that leaked to the media a while ago was designed in such broad, general terms that it carried virtually no practical value.</p>								</div>

Przyjęcie nowych przepisów jest warunkiem otrzymania części środków. Możliwe jednak, a w mojej ocenie też bardzo prawdopodobne, że do projektu będą wprowadzane zmiany na etapie parlamentarnym.</span></p>								</div>

Naturalnie także, wydanie interpretacji negatywnej dla spółki może być powodem zainicjowania kontroli przez PIP.</span></p>								</div>
